These PHOENIX Recovery Terms and Conditions ("PHOENIX Terms") supplement and are incorporated by reference into the EthicVerse OÜ Master Terms and Conditions. In the event of any conflict between these PHOENIX Terms and the Master Terms, these PHOENIX Terms shall prevail with respect to the PHOENIX Recovery service.
CRITICAL NOTICE – PLEASE READ CAREFULLY
PHOENIX provides a blockchain tracing and investigation REPORTING service. We DO NOT guarantee the recovery of your cryptocurrency. The Investigation Report is the sole and final deliverable of our service. Any further action (contacting law enforcement, exchanges, etc.) is solely your responsibility.
1. SERVICE DESCRIPTION
PHOENIX provides a blockchain tracing and investigation service that consists of:
- Analyzing blockchain data to trace the movement of cryptocurrency from the point of theft, loss, or unauthorized transfer.
- Compiling the findings into a comprehensive written Investigation Report.
- Identifying wallet addresses, transaction paths, and whether funds have reached known centralized cryptocurrency exchanges.
2. WHAT WE GUARANTEE (The Investigation Report)
We guarantee the delivery of a professional Investigation Report that includes, to the best extent technically possible:
- Tracing the flow of the stolen or lost cryptocurrency across the blockchain.
- Identifying wallet addresses involved in the movement of funds.
- Mapping the transaction path from the point of origin to the most recent identifiable destination.
- Identifying whether the funds have reached a known, centralized cryptocurrency exchange (e.g., Binance, Coinbase, Kraken, OKX, Bybit).
- Providing the relevant wallet addresses, transaction hashes (TXIDs), timestamps, and exchange deposit addresses associated with the traced funds.
The Investigation Report is the sole and final deliverable of our service.
3. WHAT WE DO NOT GUARANTEE
You expressly acknowledge and agree that:
- NO Recovery Guarantee: We do not guarantee, promise, or imply that your stolen or lost cryptocurrency will be recovered, returned, frozen, or refunded. The recovery of funds is NOT part of our service.
- NO Legal Action: We do not initiate, manage, or participate in any legal proceedings, police reports, or law enforcement actions on your behalf.
- NO Exchange Intervention: We do not contact exchanges, freeze accounts, or negotiate with third parties on your behalf.
- NO Fund Retrieval: Once the Investigation Report is delivered, our contractual obligation is fully and completely fulfilled. Any further action is solely your responsibility.
4. YOUR RESPONSIBILITIES AFTER RECEIVING THE REPORT
Upon delivery of the Investigation Report, you are solely responsible for deciding what to do with the information provided. This may include:
- Filing a report with your local law enforcement agency or cybercrime unit, attaching the Investigation Report as evidence.
- Contacting the relevant cryptocurrency exchange's compliance or fraud department directly.
- Engaging a qualified legal professional to pursue civil or criminal action.
We have no control over the actions, policies, response times, or decisions of law enforcement agencies, cryptocurrency exchanges, or any third parties you may choose to contact.
5. LIMITATIONS OF BLOCKCHAIN TRACING
You acknowledge that:
- Blockchain tracing is subject to technical limitations. Funds may be laundered through mixers, tumblers, decentralized exchanges (DEXs), privacy coins, or cross-chain bridges, which may make further tracing impossible or inconclusive.
- If funds are moved to a decentralized or unregulated platform, we may not be able to identify the final destination.
- The Investigation Report reflects the state of the blockchain at the time of analysis. Subsequent movements of funds after the report is generated are not covered.
- Some blockchain networks offer higher levels of privacy (e.g., Monero, Zcash, Dinastycoin), which may limit or prevent effective tracing.
6. NO REFUNDS
Due to the significant resources, time, and specialized expertise required to conduct a blockchain investigation, all fees for PHOENIX services are non-refundable once the investigation has commenced, regardless of the outcome or findings of the Investigation Report. This includes cases where:
- The funds cannot be traced beyond a certain point.
- The funds are traced to a decentralized or unidentifiable destination.
- The funds are traced to a known exchange but the exchange refuses to cooperate.
- Law enforcement is unable or unwilling to act on the report.
- The funds are ultimately not recovered.
7. NO FINANCIAL OR LEGAL ADVICE
PHOENIX outputs do not constitute financial, investment, legal, or professional advice. You should consult qualified professionals before making decisions based on the Investigation Report.
8. ACKNOWLEDGMENT
By purchasing PHOENIX services, you confirm that:
- You have read and understood these PHOENIX Terms in their entirety.
- You understand that you are purchasing an Investigation Report, NOT a recovery service.
- You understand that your cryptocurrency may be permanently lost and that the Investigation Report may not lead to the recovery of your funds.
- You accept full responsibility for any actions you take (or do not take) based on the information contained in the Investigation Report.
